Making a separation agreement without a lawyer in BC.

You don't need a lawyer to make a separation agreement in BC. It needs to be complete, in writing, and signed in front of a witness, and it's even stronger when reviewed by a lawyer before you sign. What you don't need is a lawyer for every step. Divii gives you a structured way to do the work yourselves and reduces the time you need with a lawyer to the part that matters.

Section 1

Everyone starts in the same place

Whatever path a separation takes, with lawyers, without them, or somewhere in between, the same work has to happen. The financial picture gets gathered. The law gets learned well enough to make informed decisions. The numbers get run. The parenting arrangements get thought through. The decisions get made and documented.

01Gather

Income, assets, debts, and the documents behind them.

02Learn

How BC family law treats property, support, and parenting.

03Calculate

Support to the Guidelines, property division, the pension.

04Decide

What you want, what works, what you can both live with.

✓Document

Every decision captured in a complete agreement.

None of that requires a law degree. It requires time, organization, and a process that keeps you on solid ground, which is exactly what Divii is. That's why everyone can use Divii: it does the education, the calculations, and the data entry that no one should be paying professional rates for, and you add professional support only where your situation actually needs it.

You don't need lawyers to do the learning and the data entry, and you don't need to assume there's going to be a fight.

Section 2

What makes it binding without a lawyer

A separation agreement doesn't become binding because a lawyer touched it. It becomes binding because it is complete, in writing, and properly signed. Signing without lawyers means two things: each of you signs a waiver of independent legal advice, which Divii includes in the document it drafts, and each signature is witnessed by an adult, someone over 19 who doesn't benefit from the agreement.

The agreement is at its strongest when each spouse instead signs in front of their own lawyer, who also signs the Certificate of Independent Legal Advice attached to the agreement. And for the question everyone asks: notarizing adds nothing. A notary is a witness who cannot give legal advice, so it does not make the agreement stronger.

The full signing picture, including the strength ladder, is in our complete guide to separation agreements in BC.

The hybrid legal approach

Technology for the work. Professionals for support and advice.

"Without a lawyer" doesn't have to mean without professionals, and it definitely doesn't mean alone. The hybrid legal approach is simple: use technology to do the work of the separation, and bring in professionals to review and provide advice and guidance. You can add them at any point throughout the process.

The distinction underneath is worth understanding. Legal information explains how the law generally works: what family property means, how support is calculated, what a complete agreement contains. Divii provides that in plain language, beside every decision. Legal advice is a professional's judgment applied to your specific situation: whether this agreement is fair for you, what risks it carries, whether you understand what you are signing. That comes from your own lawyer, and it lands best on a finished agreement.

The work · where everyone starts

Divii does the groundwork

Education, calculations, organization, and drafting. Divii walks you both through every decision, runs the numbers, and assembles your BC Separation Agreement as you go. One flat payment per agreement, spouse included.

Add support · when you want it

Professionals in the process

Want a real person alongside the technology? You can add a guidance session, a professional review of your completed file, or facilitated mediation for the terms you can't settle alone. Get in touch and we will point you to the right path. Upgrade anytime and pay only the difference; the same file carries forward.

Add advice · before signing

Your own lawyer

Independent legal advice on the finished agreement: fairness, risk, and informed consent, from a lawyer reviewing your interests alone. Short and focused, because you arrive with the work done. A practical tip: when you book, ask for a consultation for independent legal advice, so the lawyer knows you need advice on an agreement, not representation from scratch.

Mix the layers as your situation requires. It is the same file throughout, so nothing restarts and nothing you've done is wasted.

Section 4

Is doing it yourselves right for you?

Take an honest inventory. You don't need to be friendly, and you don't need to agree on everything today. You need to be able to exchange information honestly and reach decisions without one person dominating the process, together over coffee or entirely separately through the same shared file.

✓

Can you both be truthful about finances? Full disclosure is required on every path. If you suspect hidden assets, you need legal help to compel transparency.

✓

Can you speak up? If discussing separation topics leaves you intimidated or unable to state your needs, the power dynamic isn't balanced enough to do this alone.

✓

Are you both motivated to finish? The process works when both people want it done. If one of you won't engage, you'll need help moving things along.

✓

Can you disagree without one person winning every time? Healthy negotiation means both people compromise on some issues.

✓

Are you willing to learn? An hour with the guides saves many billable ones. If you'd rather not, more hands-on support is the honest choice.

When to hire your own lawyer first

Where there is family violence, coercive control, a significant power imbalance, refusal to disclose finances, or negotiations that keep breaking down despite good-faith effort, individual legal representation comes first. Even then, the groundwork above still has to happen, and Divii can help you organize information, learn the law, and run the numbers alongside your own legal support. Safety comes before savings, always.

Section 5

"Our situation is too complex" is usually wrong

Complexity alone doesn't send you to two retainers. Divii handles corporations, investment properties, pensions, RRSPs, and the equalization math that goes with them. Where complexity genuinely bites is in values and consequences: when you can't agree on what the business is worth, bring in a valuator; when you don't understand the tax consequences of a division, ask an accountant or a lawyer that specific question. Paying targeted experts for the pieces you need costs a fraction of handing the whole process over.

The Divii way

Do the groundwork. Add support where you need it.

Every tool, all the education, the calculations, and a complete BC Separation Agreement drafted from your decisions. One flat payment per agreement, spouse included. Guidance and mediation are there if you want them; get in touch and we will point you to the right path.

Without-a-lawyer questions, answered

Can we make a separation agreement without a lawyer in BC? +
Yes. A separation agreement made without lawyers is binding and strong in BC when it is complete, in writing, each of you signs a waiver of independent legal advice, and it is signed in front of an adult witness over 19. Divii includes the waiver in the document it drafts.
Do we each need our own lawyer for independent legal advice? +
Yes, if you choose to get it. Independent legal advice means each spouse meets privately with their own lawyer, who reviews the agreement with that person's interests in mind. One lawyer cannot advise both of you.
Do we need independent legal advice if we agree on everything? +
It is not required, and your agreement can be binding without it when signed with the waiver and a witness. It is still recommended: documented advice shows each of you understood your rights and made informed decisions, which makes the agreement more durable if it is ever questioned.
What if the lawyer finds problems with our agreement? +
The lawyer suggests changes; you and your spouse decide. Their role is to identify issues and give advice about fairness and risk. The decisions stay yours, and your Divii file makes any revisions quick because changing a decision updates the draft.
Is Divii only for couples who get along? +
No. You do not need to be friendly or even comfortable in the same room. What matters is that you can exchange information honestly and reach decisions without one person dominating the process. You can work through Divii together or entirely separately, in the same shared file.
What if we can't work together at all? +
Where there is family violence, coercive control, a significant power imbalance, or refusal to disclose finances, hire your own lawyer first. Even then, the groundwork still has to happen, and Divii can help you organize information, learn the law, and run the numbers alongside your own legal support.
We already have a court file. Can we still use Divii? +
Yes. Starting a court proceeding does not commit you to a trial, and about 90% of family matters are resolved without one. The work Divii does is the work a settlement takes anyway: understanding the law that applies, running the support and property numbers properly, and setting out what you want in writing. You can do that on your own or together, and bring the result to your lawyer as the basis for a settlement proposal. Divii does not replace your lawyer or manage your court file.
