Terms of Use

For separating parties and individual users.

Last updated: October 18, 2026 Applies to: divii.ca and agreements.divii.ca

These Terms of Use ("Terms") apply to individuals using Divii for their own separation or family-law matter ("Separating Parties").

These Terms do not apply to lawyers, law firms, mediators, or other family-law professionals. Legal professionals use Divii under our separate Professional Terms of Use.

Section 1Who we are (and who we are not)

Divii is operated by Congruo Solutions Inc., doing business as Divii ("Divii," "we," "our," or "us").

Divii is a legal technology company. We provide software tools that help separating couples organize information and generate separation-agreement documents more efficiently.

Divii is not a law firm. Divii does not provide legal advice. Using Divii does not create a lawyer-client relationship.

Divii provides legal information and document-drafting tools, not advice tailored to your specific situation. Every separation is different, and decisions made using Divii are your responsibility.

Section 2How Divii works: automated tools and AI-assisted features

Divii uses automated, template-based, and (in some features) AI-assisted tools to help you organize information and generate draft documents. You should understand that:

  • any document, calculation, or output generated through Divii is a draft prepared from information you provide and template logic, not a final legal instrument;
  • generated outputs may contain errors, omissions, inaccuracies, outdated information, or content that is incomplete or inappropriate for your particular situation or jurisdiction;
  • generated outputs are drafting aids only, and are not a substitute for independent legal advice, professional judgment, or lawyer review; and
  • you should not sign, file, rely on, or provide any generated document to another person without careful review and, wherever possible, review by a qualified family-law lawyer.

Section 3No guarantees or legal outcomes

Divii does not guarantee that any document created using the Services will be:

  • legally enforceable;
  • fair;
  • appropriate for your specific circumstances; or
  • upheld by a court.

The enforceability and effectiveness of a separation agreement depend on many factors, including:

  • the accuracy and completeness of the information you provide;
  • full and honest financial disclosure by both parties;
  • the absence of pressure, coercion, or unfair bargaining;
  • whether each party obtains independent legal advice; and
  • compliance with applicable provincial family-law legislation and case law.

Section 4Acceptance of these Terms

By accessing or using divii.ca, agreements.divii.ca, or any Divii tools intended for separating parties, you agree to be bound by these Terms and Divii's Privacy Policy.

By using Divii, you confirm that:

  • you are at least 19 years old;
  • you are legally capable of entering into a binding contract;
  • you are using Divii for your own separation or family-law matter, not professionally; and
  • you are not prohibited from using the Services under applicable law.

If you do not agree to these Terms, please do not use Divii.

Section 5Who these Terms apply to

These Terms apply to individuals acting on their own behalf, including:

  • Site Visitors: people browsing Divii's public website;
  • Purchasers: separating parties who have purchased Divii for their own file; and
  • Invited Users: a person invited by a Purchaser (their spouse, partner, or co-parent) to review, comment on, or collaborate on a document generated in Divii. An Invited User joins the Purchaser's file at no additional charge.

All such users are referred to as "you" or "Users" in these Terms.

Section 6Definitions

"Agreement"
means these Terms of Use together with Divii's Privacy Policy.
"Content"
means information, data, text, files, documents, and other materials you upload to, enter into, generate through, or otherwise make available to Divii.
"Confidential Information"
means non-public information exchanged between you and Divii.
"Personal Information"
means information about an identifiable individual, as defined under applicable Canadian privacy law.
"Security Breach"
means any actual or reasonably suspected unauthorized access to, disclosure of, or alteration of your Content.
"Security Emergency"
means misuse of the Services that materially threatens system integrity, security, or the data of other users.
"Services"
means Divii's software, tools, and related support.

Section 7Licence to use Divii

Divii grants you a limited, non-exclusive, non-transferable, revocable licence to use the Services for lawful, personal purposes related to your family-law matter.

You agree not to:

  • copy, sell, resell, or commercially exploit any portion of the Services;
  • reverse-engineer, decompile, disassemble, interfere with, or tamper with the software, except to the extent expressly permitted by applicable law;
  • falsely imply affiliation with Divii;
  • upload unlawful, abusive, or harmful content;
  • introduce viruses, worms, malware, spam, or destructive code;
  • share your login credentials or allow anyone else to access the Services under your account; or
  • access the Services through mechanical, programmatic, robotic, or scripted means unless expressly provided as part of the Services.

All intellectual property rights in Divii, including the software, designs, and documentation, remain owned by Divii or its licensors.

Section 8Your information, accuracy, and financial disclosure

You are solely responsible for ensuring that all information you enter into Divii is complete, accurate, truthful, and up to date.

Divii relies entirely on the information you provide and does not independently verify or validate:

  • financial information, income, expenses, assets, or debts;
  • parenting arrangements or schedules;
  • disclosure exchanged between parties;
  • valuations, assumptions, or calculations, including child and spousal support calculations, property-division calculations, and pension value estimates.

You acknowledge that full and honest financial disclosure is a fundamental requirement of valid and enforceable separation agreements under Canadian family law.

Any errors, omissions, assumptions, or failures to disclose material information may undermine fairness, affect enforceability, expose one or both parties to future legal claims, or result in an agreement being set aside or varied.

Divii is not responsible for outcomes resulting from incomplete, inaccurate, or misleading information entered by either party.

Section 9Neutral platform: you and the other party may have different interests

Divii operates as a neutral software platform designed to assist separating parties in organizing information and generating documents. Divii is neither party's lawyer, advocate, or advisor.

Divii does not:

  • act in the interests of one party over the other;
  • provide advocacy, strategy, or negotiation support;
  • assess fairness, reasonableness, or legal sufficiency;
  • advise either party on what they should agree to; or
  • owe fiduciary duties to either party.

Divii does not monitor, supervise, or control negotiations between parties. All decisions, compromises, and outcomes are made independently by the separating parties.

If you and the other party to your separation both use Divii, your interests may diverge. Divii's tools are designed to support cooperative processes, but they do not resolve conflicts, verify the accuracy of information provided by either party, or ensure that either party is being treated fairly. Responsibility for reaching, understanding, and accepting any agreement rests entirely with you and, where you obtain it, with your legal advisor.

Section 10Independent legal advice strongly recommended

Divii is not a law firm and does not provide legal advice. While Divii helps you organize information and generate structured agreement documents, it cannot advise you on your legal rights, obligations, or whether any agreement is fair, reasonable, or appropriate for your circumstances.

Separation agreements can have significant and long-lasting legal and financial consequences, including impacts on parenting arrangements, support obligations, property division, pensions, and future claims.

Divii strongly recommends that each party obtain independent legal advice from a qualified family-law lawyer before signing any agreement generated using the Services.

Independent legal advice can help ensure that:

  • you understand your legal rights and obligations;
  • you understand the consequences of the agreement;
  • full and accurate financial disclosure has been made; and
  • the agreement is more likely to be enforceable.

You acknowledge that choosing not to obtain independent legal advice is a personal decision and that, if you proceed without it, you do so at your own risk.

Independent legal advice is often a key factor considered by courts when assessing the validity and enforceability of separation agreements.

Section 11Your Content

Ownership

You retain ownership of the Content you upload, enter, or create using Divii.

Licence to Divii

You grant Divii a limited, non-exclusive, non-transferable, royalty-free licence during your use of the Services to access, use, copy, store, process, transmit, and display your Content solely to:

  • provide, operate, and maintain the Services for you;
  • prevent or address technical, security, or support issues affecting or caused by you;
  • investigate, where Divii has a good-faith belief or has received a complaint, that any Content violates these Terms;
  • comply with a valid legal subpoena, request, or other lawful process; and
  • in aggregated and de-identified form for Divii's internal analytics, provided that any such analytics cannot reasonably be re-identified to you or your family-law matter.

No sale of Content, and no third-party AI training

Divii does not sell your Content. Divii will not use your Content, and will not permit any third party to use your Content, to train third-party machine-learning or AI models without your consent.

Content shared with another party

If you invite another user (for example, your spouse or co-parent) to collaborate on a document, they will have access to the Content in that document. You acknowledge that once you share Content with another user, Divii cannot control how that user views, copies, or uses that Content.

Section 12Feedback

If you provide feedback or suggestions about Divii, you grant Divii permission to use them to improve the Services. Divii will not identify you by name in marketing materials or testimonials without your prior written consent.

Section 13Privacy, security, and where your data is stored

Privacy

Divii's collection and handling of Personal Information are governed by the Privacy Policy, which forms part of these Terms.

Where your Content is stored

Divii's primary infrastructure, where your Content is stored, is located in Canada. Certain operational sub-processors (for AI-assisted document drafting, PDF rendering, customer support, product analytics, and transactional email) process limited data in the United States. Details are set out in Divii's Privacy Policy.

Security

Divii uses industry-standard administrative, technical, and organizational safeguards to protect user information, including encryption of Content in transit and at rest, secure authentication, access controls, and reputable hosting and infrastructure providers.

No system can guarantee absolute security. You acknowledge that use of online services involves inherent risks.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Security incident notification

If Divii becomes aware of a Security Breach affecting your Content, Divii will notify you as promptly as reasonably possible, and will take reasonable steps to investigate, mitigate, and prevent recurrence.

Divii is not responsible for security incidents resulting from factors outside its reasonable control, including your own actions, compromised credentials, or third-party service failures.

Section 14Legal compliance and requests for information

Divii may disclose information if required by law, such as in response to a valid court order, subpoena, or other lawful process. Where permitted by law, we will notify you before making any such disclosure so that you have an opportunity to seek a protective order or other appropriate relief. Divii will disclose only the portion of information that it is legally required to disclose.

Divii accepts service of legal documents only at:

Congruo Solutions Inc.
201-1842 Oak Bay Avenue
Victoria, BC V8R 1C2
Canada

Section 15Backups, retention, and destruction of your Content

Backups

Divii maintains backup systems designed to allow recovery of Content in the event of data loss or corruption.

Retrieval after account closure

For a period of one (1) year following cancellation or termination of your account (the "Retrieval Period"), Divii will retain your Content in a manner that allows you to retrieve or download it on request. You may also download generated documents directly from Divii at any time during your use of the Services.

Destruction

After the end of the Retrieval Period (or earlier, on your written request), Divii will securely destroy your Content in its active production systems within thirty (30) days. Content residing in routine backup or disaster-recovery copies will be securely destroyed on the next scheduled overwrite of the applicable backup cycle, and in any event within twelve (12) months, and will remain protected in accordance with these Terms until destroyed.

Section 16Payments and refunds

  • Divii is purchased for a one-time flat fee per file. The fee is charged per agreement, not per person, and covers both parties working on the same file;
  • Divii's current plans are Divii, Divii Guided, and Divii Mediated. Their prices and what each includes are set out on Divii's pricing page, and prices are subject to applicable taxes;
  • you may move to a plan that covers more at any time and pay only the difference in price;
  • professional guidance and mediation are included in the Divii Guided and Divii Mediated plans, as described on the pricing page;
  • fees are refundable only as set out under "Refunds" below, or as required by law;
  • fees do not renew and there are no recurring charges; and
  • prices, features, and applicable taxes may change from time to time, provided that any change will not affect a file you have already purchased.

Refunds

Divii is one flat fee for a complete file, and everything is available to you the moment you buy. That is why there is no trial version. You can walk through a complete finished agreement on our free tour before you spend anything.

If you have not started the work, we will refund you. By that we mean you purchased Divii but never began working through your file: no calculations run, no schedules built, no information entered. There is no deadline on this. Tell us and we will return your fee.

We also refund in full if you and the other party each purchased a file for the same agreement, if you were charged in error or without your authorization, or if Divii cannot do what we described and we cannot put it right.

Once you have worked through your file, the fee is not refundable, whether or not you generated the final document. The value is in the work: the law you learned, the calculations you ran, and the decisions you reached. This includes the situation people ask about most, which is that the other party will not agree, or will not sign. None of what you did goes away because the other party stalled.

If you are stuck, tell us before you ask for a refund. Guidance and mediation can be added to your file, and your file carries forward with everything already in it.

If you purchased Divii Guided or Divii Mediated and the professional component has not begun, we will refund the difference between your plan and Divii. If it has begun, contact us and we will deal with it fairly.

If you think a refund is fair and it is not described here, write to support@divii.ca and tell us what happened. We would rather hear from you than have you feel taken.

Nothing in this section limits any refund or cancellation right you have under applicable law.

Section 17Suspension and termination

Termination by you

You may stop using Divii at any time, and may close your account through your account settings or by contacting us. Section 15 governs the retrieval and destruction of your Content after your account is closed.

Suspension or termination by Divii

Divii may suspend or terminate your access if:

  • you materially breach these Terms and, where the breach is capable of cure, do not cure it within a reasonable period after notice;
  • your actions create a Security Emergency or legal risk; or
  • suspension is required by law.

Where reasonable, we will provide notice and an opportunity to address the issue before suspending or terminating your access. Immediate suspension may occur in the case of a Security Emergency.

Section 18No review of final documents

Divii does not review, approve, certify, or validate any final documents before download, signing, or use.

You are responsible for reviewing all documents and deciding whether to obtain legal advice before signing.

Section 19Disputes between users

Divii is not responsible for resolving disputes between separating parties.

Any disagreement regarding content, fairness, disclosure, interpretation, or enforcement of an agreement is solely between the parties.

Section 20Force majeure

Divii is not liable for delays or failures caused by events beyond its reasonable control, including internet outages, third-party service failures, natural disasters, or government actions.

Section 21Limitation of liability

The limitations and exclusions in this Section 21 do not apply to Divii's gross negligence, fraud, or willful misconduct, or to any liability that cannot be limited or excluded under applicable law.

Subject to the above, and to the maximum extent permitted by law:

  • Divii is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profit, goodwill, or business opportunity; and
  • Divii's total aggregate liability arising out of or in connection with these Terms will not exceed the amount you paid to Divii in the twelve (12) months before the claim arose.

This allocation of risk is an essential element of the bargain and is reflected in Divii's pricing.

Section 22Disclaimer of warranties

Except as expressly stated in these Terms, and to the maximum extent permitted by law, the Services are provided "as is" and "as available."

Divii disclaims all other warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement.

Section 23Indemnification

You agree to indemnify and hold Divii harmless from any claims arising from:

  • your breach of these Terms;
  • your misuse of the Services;
  • your provision of inaccurate, incomplete, or misleading information; or
  • your infringement of any third party's rights.

Divii will indemnify you against any third-party claim alleging that the Services, as used by you as contemplated by these Terms, infringe a copyright, a Canadian patent issued as of the date you signed up for the Services, or a trademark of a third party. This indemnity is subject to Divii's control of the defence and does not apply to Content provided by you, your misuse of the Services, or your combination of the Services with other products or services.

Section 24Third-party services

Divii may integrate with third-party services that are not part of the Services and that are made available by independent providers. Use of any such service is subject to the terms imposed by its provider. Divii is not responsible for, and provides no warranties in respect of, any third-party service you elect to use.

Section 25Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and, for account holders, by email at least thirty (30) days before the updated Terms take effect. If you continue to use Divii after the updated Terms take effect, you accept them. If you do not accept the updated Terms, you may stop using the Services and close your account in accordance with Section 17 before they take effect.

Section 26Governing law

These Terms are governed by the laws of British Columbia, Canada.

All disputes will be resolved exclusively in the courts of Victoria, British Columbia.

Section 27Questions

If you have questions about these Terms, contact support@divii.ca.
